The course will discuss “when” to use Federal Court as opposed to “how” to use Federal Court. The key practical considerations is when is it really worthwhile to go to Federal Court: a practitioner’s business case. The course will discuss the key choices between: re-applying, requesting reconsideration, and the consideration of “timing” of the Federal Court process, The course reviews for each of the main immigration status categories, A Temporary Status cases – OVERSEAS (i) Study Permits (ii) TRVs (iii) Work Permits B. Temporary Status cases – INLAND (i) Study Permits (ii) TRVs (iii) Work Permits, and C. Permanent Residence cases (i) Spousal (ii) Investor (iii) PNP. The instructor will address the key points for when to consider seeking an order for mandamus in Federal Court, and the steps to take first, “before pulling the trigger”. This is an in-depth practical session geared to delivering what you need to know from a business perspective from the point of view of the professional immigration practitioner.

Lawyer and Policy Analyst

Richard is a lawyer and policy analyst at Kurland, Tobe with offices in Vancouver and Montreal. Since 1994 he has served as a member of the Social Affairs Committee in the Senate of Canada as well as the House of Commons – Standing Committee on Citizenship and Immigration. In the past, he has been the Special Advisor to the Office of the Auditor General of Canada (International Affairs and Immigration).

Richard is a regular commentator on television including CTV, CBC and CCTV as well as in newspapers and on the radio. He is the Editor-in-Chief of Lexbase, Canada’s largest immigration and policy publication.

He has lectured at the Canadian Bar Association, the Law Society of British Columbia and the University of British Columbia.
