Summary

This course provides a practical and legal overview of immigration detention, removal orders, and deferral of removal requests in Canada. Participants will examine how these three processes interact, including detention by the Canada Border Services Agency (CBSA) and the Immigration Division, the issuance of departure, exclusion, and deportation orders, and the strategic use of deferral requests to delay or stop removal. The course also explores how to prepare effective advocacy for detention review hearings, when and how to request a CBSA deferral of removal, and how to prepare for a stay of removal at the Federal Court, equipping practitioners to respond confidently in high-risk enforcement cases.

Immigration Lawyer

Beth Friesen (she/her) is a lawyer at Edelmann & Co., where she joined in 2024. Her practice focuses on criminal defence, immigration and refugee law, and appeals, representing clients across complex and high-stakes proceedings.

Beth earned her Juris Doctor and Bachelor of Civil Law from McGill University Faculty of Law in 2020 and was called to the Manitoba bar in 2022 before relocating to British Columbia. She regularly represents clients in matters involving deportation and removals, detention reviews, refugee protection and pre-removal risk assessments, misrepresentation and exclusion orders, inadmissibility, humanitarian and compassionate applications, and temporary and permanent residence, alongside a broad criminal defence practice.

Known for her strategic, research-driven, and client-led advocacy, Beth has appeared before the Provincial and Superior Courts, the Refugee Protection and Immigration Division, the Immigration Appeal Division, Federal Court, and numerous administrative tribunals.
